ARTICLE 1 – DEFINITIONS
Lessor: a natural person or legal entity who enters into an agreement regarding the provision of a Stichting Warm Hearts Floating Sauna.

Tenant: a natural person who is not acting in the exercise of a profession or business (consumer) and who enters into an agreement regarding the use of a vessel from the lessor, a Stichting Warm Hearts Floating Sauna.
ARTICLE 2 – MODIFICATION AND CANCELLATION
Tenant must cancel or change the booking themselves via the link in the confirmation email. Renter can cancel a reservation up before the start, in which case a new time to book is offered. The lessor may cancel a booking at any time in the event of force majeure (see Article 5). In case of cancellation, a new time to book is offered.
ARTICLE 3 – GENERAL PROVISIONS
The Tenant and all co-passengers must have read and respect the Warm Hearts Sauna Rules (link). Verbal and non-verbal disruptive behavior and intimate physical contact is not allowed. We reserve the right to refuse entry or ask people to leave if they are excessively drunk, under the influence of drugs or are engaged in any kind of inappropriate or sexual behavior. Any behavior, that may damage the reputation of the company, such as sex, violence and drugs, will not be tolerated and we reserve the right to press charges against anyone who does so.

The Renter may not make any changes to the vessel, and do not operate the vessel.
The Renter must report any damage of any nature whatsoever, or facts and/or circumstances that could reasonably lead to damage, to the Lessor as soon as possible. If damage results from unreported facts, this will be for the account of the Tenant.
The Tenant must adhere to the instructions of the Lessor.
Swimming and using the sauna is at your own risk. The Tenant must have third-party liability insurance.
ARTICLE 4 – LIABILITY
The use of the sauna is at your own risk, as is swimming and the storage of personal belongings in the changing room. Warm Hearts Sauna is not liable for damage and theft of any kind. Warm Hearts Sauna is only liable for direct damage caused by intent or deliberate recklessness of Warm Hearts Sauna.

Guests are personally liable for all damage they cause to Warm Hearts Sauna or any third party, including violating the sauna rules, damaging Warm Hearts Sauna's property, or negligence when leaving the sauna. Warm Hearts Sauna recovers any costs incurred, including repairs and cleaning, from the guests. The Renter is not liable if he can demonstrate that the damage is not attributable to him and/or to one of his co-passengers.

If the Tenant acts contrary to the Warm Hearts Sauna Rules (link) and the instructions of the Lessor, the Tenant is fully liable for any (consequential) damage caused by them.
The Lessor is not liable for damage to property or for any physical injury, unless such damage and/or injury is the direct result of a defect in the Warm Hearts Sauna made available by the Lessor, which defect must be borne by the Lessor.
ARTICLE 5 – FORCE MAJEURE
The Lessor may at any time change, cancel, or terminate a booking in the event of force majeure, including (but not limited to) bad weather, sudden and unexpected defects to the Warm Hearts Sauna, illness, natural disasters, unexpected government measures, quarantines, an epidemic, war, or other impediments.

The Lessor reserves the right to assess whether the weather is good enough to sail out or to use the Warm Hearts Sauna in the harbour. In the event that the weather is too bad to sail out, it will first be assessed whether the Warm Hearts Sauna can be used in the harbour. If not, the booking will be changed or cancelled.
