1. Applicablity
1.1 It is important that you read these Terms and Conditions carefully before using Our Sauna. The Terms and Conditions apply to the use of Our Sauna. When you use Our Sauna, You agree to the terms described below. Our Sauna can be used free of charge under the conditions of these Terms and Conditions. Stichting Warm Hearts Floating Sauna reserves the right to amend these Terms and Conditions. Changes will be communicated via the Website and will take effect from the moment of publication on our Website.
1.2 Our Sauna is designed to bring people together from diverse backgrounds, fostering a sense of community and goodwill. This way we create a ripple effect of kindness in Amsterdam!
2. Definitions
2.1 In these Terms and Conditions, various definitions are used (both in singular and plural) with the following meanings:

Sauna:
the floating sauna of us lying in Sloterplas in Amsterdam, the Netherlands;
Sauna Rules:
the house rules which are applicable for the use of the Sauna, www.warmheartssauna.com/sauna-rules;
Skipper:
the volunteer who operates and supervises the Sauna on behalf of Stichting Warm Hearts Floating Sauna;
Stichting Warm Hearts Floating Sauna:
Stichting Warm Hearts Floating Sauna, based in Amsterdam, the Netherlands;

4. Making, adjusting and canceling booking
4.1 Through Our Website, You can make a reservation for Your visit. You can choose between two different bookings: the Social sauna, where You share the sauna with five different people, or the Private sauna, where You can use the sauna with friends or an organization.
4.2 A booking for the Social sauna is free. You only need to have performed a good deed of Your choice. When making the booking, You send a photo (optional) and a short story about the good deed. The good deed must have been performed before You make the booking.
4.3 A booking for the Private sauna is based on donations. You will receive instructions after making a booking request.
4.4. We only accept booking requests from and for persons aged 18 or older.
4.5 We reserve the right to refuse a booking request without giving reasons. After booking, You will receive a confirmation via email. You must check the booking and confirmation for accuracy Yourself.
4.6 You must change or cancel the reservation Yourself via the link in the confirmation email. You can change or cancel a reservation up to 48 hours before the start of Your booking, in which case a new booking time will be offered. We can change or cancel a booking at any time in case of force majeure (see article 9). In case of cancellation, a new booking time will be offered.
5. General house rules
5.1 The use of the Sauna is at Your own risk. By agreeing to these Terms and Conditions, You acknowledge that You have third party liability insurance (WA-verzekering).
5.2. You and all passengers must have read and respect the Sauna Rules. The Sauna Rules can be found on Our Website and are attached to these Terms and Conditions as Appendix 1. Verbal and non-verbal disruptive behaviour and intimate physical contact is not allowed. We reserve the right to deny access or ask people to leave. Any behaviour that can damage Our reputation, such as (but not limited to) sex, violence, and drugs, will not be tolerated, and We reserve the right to file charges against anyone who engages in such behaviour.
5.3. You must follow all instructions given by Us or the Skipper at the time of or prior to Your visit. You must adhere to all instructions given by Us or the Skipper. We or the Skipper will give You instructions regarding Your own safety.
5.4 You are not allowed to make any modifications to the Sauna or operate the Sauna in any way.

5.5 You must report any damage of any kind, or facts and/or circumstances that could reasonably lead to damage, to Us as soon as possible. If damage results from unreported facts and/or circumstances, it will be at Your expense and risk.
5.6 The Sloterplas, where the Sauna is located, has not been designated as an official swimming location by the province of North Holland. This means that the water quality is insufficient to be classified as a swimming location within the meaning of the Environmental Quality Decree (Besluit kwaliteit leefomgeving). It is Your own responsibility to check the status of the water quality of the Sloterplas. You can find this information on the Website of the municipality of Amsterdam. Swimming during Your visit to the Sloterplas is entirely at Your own risk.
6. Liability
6.1 The use of the Sauna, swimming in the Sloterplas, and storing personal belongings in the changing room is entirely at your own risk. We accept no liability for theft, loss, and/or (injury) damage to property or persons, of any kind, during, or as a result of or in connection with a visit to the Sauna, the use of the Sauna, and/or swimming in the Sloterplas. We also accept no liability for other forms of damage, including (but not limited to) financial loss that is not the direct result of property damage or personal injury. We accept no liability for the malfunction or out-of-service condition of the Sauna
6.2 You expressly declare that you are sufficiently skilled in swimming and are aware of the risks associated with the use of the Sauna and swimming in the Sloterplas, including – but not limited to – the risk of injury, drowning, slipping, falling, damage due to exposure to blue-green algae, and other incidents in and around the Sauna and the Sloterplas. You are also aware that, especially (but not exclusively) in cold outdoor temperatures, the water of the Sloterplas can be very cold, with associated risks such as hypothermia and other health risks. You expressly accept these risks and the associated liability.
6.3 We only accept liability for direct damage caused by intentional or reckless misconduct on our part or for damage and/or injury as a direct result of a defect attributable to us in the Sauna provided by us. However, we are not liable for damage as referred to in the previous sentence if that damage was caused by intentional or gross negligence of third parties engaged by us.
6.4 You are personally liable for all damage you cause to us or a third party (such as our volunteers, cleaners, or the Skipper), including, but not limited to, damage by damaging our property and/or negligence. This includes, in any case, not following the sauna rules, safety instructions, hygiene rules, using prohibited items/substances, and disturbing the order when using and leaving the Sauna. We will recover all costs incurred in this regard, including repairs and cleaning, from you and the other guests present. You are not liable if you can prove that the damage is not attributable to you and/or one of your fellow travelers. You are personally liable for all damage You cause to Us or a third party, including but not limited to, damaging our property or negligence when leaving the Sauna. We will recover all incurred costs, including repairs and cleaning, from You and the other guests present. You are not liable if You can prove that the damage cannot be attributed to You and/or any of Your fellow travellers.
6.5 If You act in violation of the Sauna rules and/or our or the Skipper's instructions, You are fully liable for all (consequential) damage caused as a result. We reserve the right to recover the full costs from You.
7. Privacy and processing personal data
7.1 We process your personal data in accordance with all (legal) regulations concerning the data to be processed, including in particular the regulations established by or pursuant to the General data protection regulation (GDPR). 8. Intellectual property
8.1 The existing and future intellectual property rights relating to work created by Stichting Warm Hearts Floating Sauna, including but not limited to trademark rights, domain name rights, design rights, trade name rights, photographic recordings, drafted documents, designs, data, and documentation, shall remain vested in Us.
8.2 It is not permitted to reproduce, disclose, or exploit the aforementioned intellectual property rights mentioned in article 8.1 of Stichting Warm Hearts Floating Sauna without prior permission from Us.
8.3 All communication via (among others) social media regarding Stichting Warm Hearts Floating Sauna and the Sauna must first be shared with Us in writing and may only be shared externally after Our approval.
9. Force majeure
9.1 We may at any time change, cancel, or terminate a booking in the event of force majeure, including (but not limited to) bad weather, sudden and unexpected defects to the Warm Hearts Sauna, illness, natural disasters, unexpected government measures, quarantines, an epidemic, war, or other impediments.
9.2 We reserve the right to assess whether the weather is good enough to sail out or to use the Sauna in the harbour. In the event that the weather is too bad to sail out, it will first be assessed whether the Sauna can be used in the harbour. If not, the booking will be changed or cancelled. Our assessment of the weather is not open for discussion and is for your own safety.
10. Miscellaneous provisions

10.1 If you make a booking for Our Sauna (also) on behalf of other visitors, you acknowledge that it is Your responsibility to inform the other visitors of these Terms and Conditions and to prove that You have done so. These (co-)visitors are also bound by these Terms and Conditions.
10.2 If You have any complaints about Us or the Sauna, You must notify Us in writing, with reasons, no later than 30 (thirty) days after You become aware of them, under penalty of forfeiture of any possible right to compensation and the right to file a complaint and/or (legal) claim.
10.3 If any provision of these Terms and Conditions is null and void or annulled, the remaining provisions shall remain in full force and effect. The parties will then consult to agree on a new provision, taking into account as much as possible the purpose and intent of the null and void or annulled provision.
10.4 We reserve the right to amend these Terms and Conditions at any time. In the event of any changes, the amended Terms and Conditions will be published on our Website. The version of the Terms and Conditions applicable to your reservation and visit shall be the version in effect at the time you made your reservation through our Website.
11. Applicable law and jurisdiction
11.1 The use of the Website, the Sauna, the Sauna Rules and these Terms and Conditions are exclusively governed by Dutch law. Any dispute arising from or related to the Website, the Sauna, the Sauna Rules or these Terms and Conditions will be submitted to the competent court in the Netherlands.

Annex 1 – Sauna House rules
Our floating sauna is fuelled by kindness, therefore we believe kindness won’t be an issue! However, we ask all visitors to follow a few simple rules:
1. Wearing swimwear is mandatory.
2. Safe sauna experience for all. We don’t tolerate any disrespectful behavior.
3. Swimming ability is a mandatory requirement for boarding. Using the sauna is always at your own risk.
4. Swimming at the Sloterplas is also at your own risk. The Sloterplas is not an official swimming location. It's your responsibility to check the current water quality status. You can find updates on the Municipality of Amsterdam’s website.
5. Guests don’t operate the engine or the stove.
6. No jumping into the water when the raft is moving. Never swim alone.
7. Avoid rapid temperature changes. After the sauna, wait 30sec - 1 minute before going to the cold water.
8. Stay helpful if the skipper needs assistance with docking.
9. Only use tap water on the stove.
10. Use a towel on the sauna benches.
11. No shoes in the sauna area.
12. Moderate alcohol consumption is permitted. Maximum 2 drinks on board per person.
13. Listen to your body when it’s time to have a break from the heat. Drink lots of water!
14. Smoking is prohibited in the sauna.
15. We love capturing the warmth of our events to share the spirit of Warm Hearts on our website and social media. We ask your permission for this when you book our sauna.
Saying yes is totally up to you, and you can change your mind anytime. For all the details, check out our privacy statement.
16. Chatting is encouraged! Get to know other good-doers in the sauna.
17. The weather is always checked before a sauna session. Stichting Warm Hearts Floating Sauna reserves the right to cancel the reservation for safety reasons.
18. We love our Sloterplas. Please help us keep it clean by not leaving any waste behind. Use the bins provided on the shore.
19. If guests don’t respect the sauna rules, the sauna returns to the shore.
